Blanton's Heating and Air Conditioning and Lennox and 95.7 WKML will present the designated receiving homeowner an air-conditioning system* based on needs of the homeowner's dwelling, built around the quality of the Lennox Comfort System, and ordered and installed at the professional discretion of Blanton's Heating and A/C to provide the homeowner with a functional, practical HVAC solution for his/her residential dwelling.

* The materials and services to be provided by Blanton's Heating and A/C and Lennox hold no cash value to the recipient. Although no cash value is assigned to the award, the mean average retail price of materials and services provided by Blanton's Heating and A/C is nominally assigned at about $8,000, although this amount could vary depending upon condition of present system and upgrade needs assessed by, and at the sole discretion of Blanton's Heating and A/C.

"Summer Cool Down" Contest Rules

How to Enter and Play
1. Entrant must nominate a person whose home needs a new cooling system. Entrant must state, in 50 words or less, why the person he/she is nominating deserves to win a new cooling system from Blanton's Heating and Air Conditioning.
2. Entrant must submit his/her own name, address, city-state-zip, a daytime telephone number and email address, as well as the name, address, city-state-zip and telephone number (if known) of the person being nominated.
3. Entrant may nominate a person in his/her own household. Only one entry permitted per household.
4. WKML shall accept entries into the "Summer Cool Down" Contest on the WKML website, www.wkml.com, or on paper in legible print (typed or neat block letter print), hand-delivered or mailed to: "Summer Cool Down", WKML Studios, 508 Person Street, Fayetteville, NC 28301.
5. Entrants shall read and agree to all the rules.
6. Contest entries will be accepted from May 1, 2010 until 12:01p.m. Tuesday, June 1, 2010. Entries hand-delivered or sent via U.S. Mail must be received at the WKML Studios, 508 Person Street, Fayetteville, NC 28301, by June 1, 2010.
7. Winner of contest will be announced on WKML on Friday, June 4, 2010. Winner need not listen to win. Winner will be notified via email and/or telephone.
Eligibility Restrictions
1. The entry will be qualified by the following factors before being accepted as a valid contest entry and posted on the WKML website:
  1. Nominee must be the owner of the home located at the address provided and must live at the address provided. The address provided must be the primary residence of the nominee.
  2. Entrant must provide his/her own home address.
  3. Entrant must reveal a compelling story as to the need of the nominee for a new cooling system in 50 words or less
  4. The nominee's property must be located within the listening area of WKML.
  5. Entrant and Nominee must be 18 years of age or older.
  6. One entry per household per contest.
  7. Nominee must agree to have his/her cooling system upgraded according to the discretion and standards of Blanton's Heating and A/C of Fayetteville.
  8. Nominee must agree to have his/her photo(s) and story shared on WKML and wkml.com.
  9. Nominee must agree to allow Blanton's Heating and A/C of Fayetteville necessary access to any and all areas of home necessary to do a professional installation of a heating system should nominee become the recipient of awarded system.
  10. Once qualified and accepted as a valid contest entry, portions of the nomination pertaining to need will appear on the WKML website for the duration of the contest.
2. Employees of Beasley FM Acquisition Corp./WKML, its corporate licensee and parent corporation; the officers, shareholders, directors, employees, agents, representatives, and subsidiary companies of each such corporation, WKML affiliated advertising agencies, participating sponsors/promotional partners, other broadcast stations affiliated with WKML, any Fayetteville area radio station and the members of their immediate families are ineligible to participate or win.
  
  Listeners are eligible to win a prize valued at $600.00 or more only once every six months on WKML and/or any other BBGI/Fayetteville station.
Prize: Blanton's Heating and A/C of Fayetteville and WKML will award one (1) prize to one homeowner who was nominated by the winning entrant. The prize shall consist of a Lennox cooling system based on needs of the homeowner's dwelling, built around the quality of the Lennox Merit series, and ordered and installed at the professional discretion of Blanton's Heating and A/C to provide the homeowner with a functional, practical HVAC solution for his/her residential dwelling. The type and specifications of the cooling system installed will be at the sole discretion of Blanton's Heating and A/C of Fayetteville.
The materials and service to be provided by Blanton's Heating and A/C holds no cash value to the recipient. Although no cash value is assigned to the award, the mean average retail price of materials and services provided by Blanton's Heating and AC is nominally assigned at approximately $8,000.00, although this amount could vary depending upon condition of present system and upgrade needs assessed by, and at the sole discretion of, Blanton's Heating and A/C.

Selection of Winners
1. A panel of judges will be commissioned by WKML and Blanton's Heating and A/C of Fayetteville to judge all eligible entries based upon need.
2. From all eligible entries, one will be selected to receive a system based on the needs of the homeowner's particular dwelling, built around the quality of the Lennox Merit series, and ordered and installed at the professional discretion of Blanton's Heating and A/C to provide the homeowner with a functional, practical HVAC solution for his/her residential dwelling.
3. Nominated homeowner of selected winning entry will be given a certificate by WKML and Blanton's Heating and Air Conditioning describing the prize in terms of Paragragh 4c above. The certificate will also describe how to contact Blanton's Heating and Air Conditioning to arrange redemption of the certificate. Failure to claim prize by the specified time will result in forfeiture of the prize.
4. Winner of contest will be announced on WKML on Friday, June 4, 2010. Winner need not listen to win. Winner will be notified by email and or phone. If winner cannot be contacted within 30 days after the prize is awarded, an alternate winner will be selected.
5. Decisions of station management with respect to the contest are final.
Special Internet Rules
1. Station is not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches.
2. Contest participants using the Internet must provide a valid email address.
3. WKML and sponsors not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by WKML, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant's ability to participate.
4. WKML reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of the station corrupt the administration, security or proper execution of game or contest. WKML, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by these rules, and the Official General Rules appearing above.
5. To enter online, you must enter your first name and last name, complete address, city, state, zip code, home telephone number and a valid email address in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.
6. WKML, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WKML website or who is otherwise in violation of the rules. The station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
7. The use of automatic voting program(s) and/or website(s) is prohibited and will result in nullifying all votes from these programs/websites or disqualification of contestant. Penalty will be the sole decision of the judge(s).
Mailed or Hand-delivered Entries
1. WKML is not responsible for lost, stolen, mutilated, misdelivered, postage due, illegible, incomplete or untimely entries.
2. WKML reserves the right to disqualify from consideration any entry found to be unclear, illegible or ambiguous.
Conditions
1. Taxes and Liability: Payment of all federal, state and local taxes is the sole responsibility of the winner. Contest winnings will be reported to the Internal Revenue Service and winners can expect to receive a 1099 tax form for prizes which total more than $600 for the year.
2. By participating in the contest, contestant agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation.
3. Contest winners (and their guests or travel companions, if any) will be required to sign a liability release and a publicity release. Pursuant to the liability release, the winners will agree to hold WKML/Beasley FM Acquisition Corp., its corporate licensee, its corporate parent, their affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
4. WKML will be excused from its obligation to air the contest if its performance is delayed or prevented due to causes beyond its control, including, but not limited to acts of God, public enemies, war, civil disorder, fire, flood, hurricanes, explosion, labor disputes or strikes, and any acts by any governmental authority.
5. WKML, its corporate licensee and parent corporation and subsidiaries of such corporations thereof, are not responsible for failure to conduct or for alterations to the contest due to circumstances beyond the control of any such entity.
6. WKML reserves the right to end this contest or amend these rules upon announcement on air or publication at www.wkml.com.
7. WKML reserves the right to make changes to the rules of the contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.
8. WKML is not responsible for any prizes or certificates lost or stolen after the winner has claimed them from the station.
9. Prizes are awarded 'as is' with no guarantees or warranties as to use. Acceptance of a prize releases WKML, its sponsors and advertisers from all liability and claims concerning the prize, its delivery, and its use.
10. WKML is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.
11. By participating in this contest, listeners agree to be bound by these rules. Failure to comply with the contest rules may result in a contestant's disqualification, at the sole discretion of WKML.
12. Any materials submitted become the property of the station and will not be returned.
13. No purchase is necessary. The contest is void where prohibited. Contests and promotions subject to all federal, state and local laws.
